Council of Ministers Resolution No 158/2025 of 13 October
Summary: Approves the Action Plan of the Single Strategy for the Rights of Children and Youth 2025-2030.
Ministerial Implementing Order No 228/2025/1 of 21 May 2013
Approves and regulates the revised Domestic Violence Risk Assessment Instrument (RVD-R).
According to Article 8(3): ‘Without prejudice to the provisions of the preceding paragraph, in cases of high or extreme risk, the focal points of the competent entities shall promote, by the most expeditious means, communication between the services of the Public Prosecutor’s Office, the GNR, the PSP, the PJ, the CIG/RNAVVD, the Directorate-General for Reintegration and Prison Services, the National Institute of Legal Medicine and Forensic Sciences, the Committees for the Protection of Children and Youth, where there are children involved, and other bodies or services territorially competent, ensuring the application of measures deemed appropriate to promote the safety of the victim.’
Rectifies Law No. 39/2025, of 1 April, which prohibits the marriage of minors and includes child, early or forced marriage in all situations of danger that legitimize the intervention to promote the rights and protection of the child and young person in danger, amending the Civil Code, the Civil Registry Code and the Law for the Protection of Children and Youth in Danger.
Ministerial Implementing Order No 197/2025/1 of 21 April 2013
It amends for the first time Ministerial Implementing Order No 450/2023 of 22 December 2023 laying down the arrangements for the organisation, operation and installation of foster homes for children and young people and defining the model for the financial contribution of the units making up the foster home, and repeals Ministerial Implementing Order No 95/2024/1 of 11 March 2024.
It rectifies Law No 37/2025 of 31 March, which allows family members and persons applying for adoption to be foster families and strengthens the rights of children and young people in foster care, amending Law No 147/99 of 1 September 1999 and Decree-Law No 139/2019 of 16 September 2019.
Amends the Civil Code: It puts an end to emancipation, so from now on it is impossible for anyone under the age of 18 to marry, even with the permission of their parents. The marriage celebrated under these conditions until yesterday will remain valid.
